As Gitmo Plods, Obama's Winning The Case For Court


WASHINGTON (AP) — Four years after his failed effort to bring the 9/11 mastermind to New York for trial, President Barack Obama has reinstated the federal courthouse as America's preferred venue for prosecuting suspected terrorists.


His administration has done so by quietly securing conviction after conviction in the civilian judicial system. Meanwhile at Guantanamo Bay, admitted 9/11 mastermind Khalid Sheikh Mohammed's case moves at a snail's pace.


Tuesday's expected arraignment of suspected al-Qaida member Abu Anas al-Libi is the latest example of Obama's de facto policy. Al-Libi was captured in a military raid in Libya earlier this month and had been under interrogation aboard a U.S. warship.


The Obama administration says it considers all options for prosecuting terrorists, weighing military and civilian trials on a case-by-case basis.


But Guantanamo Bay, the U.S. military base that embodied America's post-9/11 methods of interrogating and prosecuting suspected terrorists, has turned into a legal morass. The military commission's poor case record has become less about winning and more about completion.


While the Justice Department says more than 125 people have been convicted of terrorism charges in federal courts since 2009, not a single military commission has come to a close during that period.


Of the few military commissions completed under President George W. Bush, most resulted in short sentences or have been overturned.


"There's really no comparison in terms of the success rate," said David Raskin, the former top national security prosecutor at the U.S. Attorney's Office in Manhattan. "Not really between wins or losses, just finishing the cases. There's no comparison at this point."


The politics are breaking Obama's way too.


When Attorney General Eric Holder announced in 2009 that Mohammed would be tried in New York City, the outcry from both political parties was great.


Some feared a high-profile terrorism trial would put the city at risk. Others said a civilian courthouse, with all the rights afforded defendants there, was no place for a terrorist.


Obama, who came into office promising to close Guantanamo Bay and prosecute terrorists in federal courts, buckled under the pressure and pulled the case back to Guantanamo.


Since then, not much has changed at the naval base in Cuba. Mohammed is one of 164 men held there and one of six facing trial. Those trials have stalled largely because of legal challenges to the commission system itself.


In federal courts, however, the Obama administration is quietly churning through terror cases and putting many terrorists away for life.


One of the first key cases was against Ahmed Ghailani, a former Guantanamo detainee who was transferred to New York early in Obama's administration. He was convicted in 2010 and is serving a life sentence in prison.


Last year, Mohanad Shareef Hammadi, an Iraqi man, pleaded guilty to terrorism charges in Kentucky and was sentenced to life in prison without parole. Hammadi's co-defendant got a 40-year sentence for his role in a plot to ship weapons and cash to insurgents in Iraq.


Ahmed Abdulkadir Warsame, a Somali citizen accused of helping support and train al-Qaida-linked militants, pleaded guilty earlier this year. Like al-Libi, he was questioned aboard a U.S. warship before being turned over to the civilian justice system.


Each new trial brought fresh criticism from Republicans, but that criticism diminished each time.


Some Republican lawmakers criticized Monday's announcement that al-Libi would face trial in court. They questioned whether interrogators questioned him long enough.


"It certainly begs the question whether rushing foreign terrorists into U.S. courts is a strategy that is in the best interests of the United States," said Rep. Bob Goodlatte, R-Va., the chairman of the House Judiciary Committee.


But in the midst of a major budget debate in Washington, the matter got little attention.


The White House, which once fought back against such criticism, now shows little interest in renewing a debate that proved to be a political distraction.


So the administration said nothing when al-Libi arrived in the United States on Saturday. Preet Bharara, the U.S. attorney for the southern district of New York, issued a two-sentence statement Monday, saying only that al-Libi was due in court to answer charges dating back more than a decade.


Al-Libi, whose full name is Nazih Abdul-Hamed al-Ruqai, is accused of helping plan and conduct surveillance for the 1998 bombings of U.S. embassies in Africa.


"A federal civilian criminal trial is by far the safest and the one that would raise the least complex set of legal problems for the administration," said Steve Vladick, a professor at American University law school.


That's because al-Libi was indicted more than a decade ago, which meant the government did not need any evidence it gathered against him during his interrogation.


Intelligence officials questioned him for a week aboard the USS San Antonio. Interrogations at sea have replaced CIA "black sites" as the U.S. government's preferred method for holding suspected terrorists and questioning them without access to lawyers.


Al-Libi's al-Qaida ties date back to the terrorist group's early years, according to court documents. That would make him a valuable source of information about the group's history.


In an interview last week on the PBS program "NewsHour," Lisa Monaco, the president's homeland security adviser, said the first priority in capturing al-Libi was to get intelligence.


"I think what it shows is a very clear strategy by the U.S. government to use all the tools, frankly, in our toolbox to disrupt threats, to go after — consistent with the rule of law — individuals who pose a threat, to get intelligence and then ultimately to make a decision about what the best disposition is," Monaco said.


So far, in every instance that the Obama administration has had a terrorist suspect in custody, it has found the best disposition was the federal court system.

Newtown, Conn., to keep school razing under wraps

HARTFORD, Conn. (AP) — When the old Sandy Hook Elementary School is demolished, building materials will be pulverized on site and metal will be taken away and melted down in an effort to eliminate nearly every trace of the building where a gunman killed 26 people last December.


Contractors also will be required to sign confidentiality agreements and workers will guard the property's perimeter to prevent onlookers from taking photographs or videos.


The goal is to prevent exploitation of any remnants of the building, Newtown First Selectman E. Patricia Llodra said Tuesday.


"We want to be absolutely certain to do everything we can to protect the privacy of the families and the Sandy Hook community," she said. "We're going to every possible length to eliminate any possibility that any artifacts from the building would be taken from the campus and ... end up on eBay."


Demolition is set to begin next week and be finished before the Dec. 14 anniversary of the shootings. Town voters last month accepted a state grant of $49.3 million to raze the building and build a new school, which is expected to open by December 2016.


The contractors' confidentiality agreements, which were first reported Monday by The News-Times of Danbury, forbid public discussion of the site as well as photographs or disclosure of any information about the building.


Llodra, the superintendent of schools and other town officials have been discussing how to handle the demolition for weeks. Llodra said they want to shield the victims' families and the community from more trauma, and don't want any part of the school used for personal gain.


Most of the building will be completely crushed and hauled away to an undisclosed location. Some of the demolition dust may be used in the foundation and driveway of the new school, Llodra said. The town also is requiring documentation that metal and other materials that can't be crushed and are hauled off-site are destroyed, she said.


In addition to the demolition crew confidentiality agreements, the project management company, Consigli Construction, also may do background checks on the workers.


"It's a very sensitive topic," Selectman Will Rodgers told The News-Times. "We want it to be handled in a respectful way."


Adam Lanza, 20, killed 20 first-grade children and six women inside the school before committing suicide. Authorities have not disclosed a possible motive for the massacre.


Sandy Hook students have been attending classes at a former school in neighboring Monroe that was renovated specially for them.

Link replaces Jurgen Horner, who has been ProSiebenSat.1 head since July, 2012. Horner said he is leaving on his own accord to set up his own media firm.


Link has run the group's flagship channel, Pro7, for more than a year now, where he has boosted ratings and market share. In September, Pro7 took a 12 percent share of the key 14-49 demographic, coming within shouting distance of market leader RTL, which has 13.2 percent.

How Will The Fiscal Mess In Washington Impact Twitter's IPO?

As excitement grows for the upcoming Twitter IPO, the federal government shutdown and pending debt-ceiling issue looms large. There are some in Silicon Valley who believe that the current innovation cycle, powerfully led by mobile and cloud computing, will overwhelm any public market dislocation caused by Washington D.C. ineptitude.


After all, Twitter and other high fliers, such as the rumored 2014 IPO class — including Dropbox, Palantir, Airbnb and Box — are growing fast, operating in huge markets with big and slow-moving incumbents and beginning to show business models that will generate meaningful profit. This has been the recipe of success for LinkedIn, Splunk, Workday, ServiceNow and even Facebook, where IPO investors have done extremely well.


Recent history suggests, however, that in times of macroeconomic disruption, even the strongest of companies can see their IPO price get hit hard. One good way to assess the severity of a market dislocation caused by external events is the VIX, a measure of the implied volatility of the S&P 500.


The chart below from the folks at Deutsche Bank plots the VIX relative to IPO pricing over the past three years. As you can see, during periods when the VIX spikes due to external events, the implied IPO pricing discount increases sharply. For example, during the late summer/early fall 2011 period when U.S. debt was downgraded after the failed debt-ceiling negotiations followed quickly by the Greece-led Euro crisis, the VIX spiked and IPO pricing discounts went from an average of approximately 20 percent down to over 50 percent. Similarly, when the fiscal cliff led to the automatic federal spending cuts in early 2013, the VIX sharply increased, sending ensuing IPO discounts up to over 30 percent, from a range of 10-20 percent in the months prior.

Should the mess in Washington go unresolved over the coming several weeks, a clear risk for Twitter is that the VIX spikes up. If this happens, recent history suggests that Twitter will be forced to price its IPO well below levels it could otherwise achieve.


While this situation, if it transpires, will cause Twitter to either raise less capital or suffer more dilution than it would have otherwise, all is not lost. Aftermarket performance of the IPOs that have priced in the last three years doesn’t appear to be highly correlated to IPO pricing.


In fact, as you can see from the chart below, some IPOs that price at steep discounts perform quite well in the ensuing 30 day period. For example, IPOs that priced in mid 2012, during the height of the macro concerns in Europe, were done at steep discounts, yet these IPOs were up 15-32 percent on average in the ensuing 30 days. More recently, IPOs priced at a steep discount during the “taper talk” of this past summer, but this class also performed very well in the ensuing 30 days. So, while Twitter may face IPO headwinds if Washington doesn’t come to its senses soon, a buying opportunity may follow.

Whatever happens, Twitter’s long-term stock price trajectory will have everything to do with its operating performance and the market around it, and very little to do with how its IPO fares.

Thursday Gut Check: California’s new abortion law

From MSNBC.com: For years, lawmakers from the U.S. Senate to states across the country have cited the abuses at Kermit Gosnell’s Pennsylvania clinic to restrict access to abortion. Today, California Governor Jerry Brown didn’t mention Gosnell’s name, but by signing the Early Access to Abortion Bill into law, he did more than any of those legislators to prevent another Gosnell.

CSN: Daulton diagnosed with brain cancer

Former Phillie Darren Daulton has been diagnosed with glioblastoma, an aggressive form of brain cancer.

The news comes just over a week after Daulton had surgery to remove two tumors in his brain.

"It saddens me, but I'll remain optimistic," Phillies GM Ruben Amaro said prior to Wednesday's game against the Nationals. "I guess he's in Florida now, hoping and praying that things go well for him. I know he's probably got a tough road ahead of him, but I hope it goes well."

Daulton, who had been hosting a radio show on 97.5 FM The Fanatic, has returned to Clearwater, Fla., to recuperate and will eventually begin treatments in Florida.

"Darren and his family wish to thank everyone for their loving support throughout this difficult time," read a statement from the Darren Daulton Foundation. "He is deeply touched. In typical fashion, he again said, 'Right on; Fight on.' Darren and his family request that everyone respect his privacy and that of his family during this period of time. At his urging, I can report that the September 9, 2013, golf tournament that benefits the Foundation will continue as planned."

The catcher, who spent 14 seasons with the Phillies, underwent surgery on July 2 at Thomas Jefferson University Hospital. Though doctors said the surgery "went well," they did not specify whether all the malignant cells in Daulton's brain had been removed.

Dr. Donald O?Rourke, a neurosurgeon in the University of Pennsylvania Health System, said (video above) that part of the tumor's severity is its origin in the brain.

"Glioblastoma is a very difficult, challenging tumor that starts in the brain. So it's not a tumor that started elsewhere in the body and traveled to the brain. It's something that actually started in the brain," O'Rourke said. "So if you can imagine a tumor growing within the brain, it's going to be integrated with normal tissue. So one of the challenges as a surgeon is to be able to remove the tumor while respecting the normal tissue."

O'Rourke also said Daulton's doctors should treat the tumor "aggressively" based on Daulton's current health along with the strong possibility of experimental courses of action.

"In a healthy person like [Daulton] who's in the prime of their lives, the only way to treat this tumor is to be aggressive. That's aggressive surgically and and it's aggressive with every other aspect of care," O'Rourke said. "The care will be a standard radiation regimen, which will be daily for five to six weeks. There will be an oral chemotherapy pill associated with that.

"And then we would recommend, and I assume his caretakers will also recommend, is potentially doing something experimental in addition to that. That's sort of where the hope and the promise of the future holds, with some of the experimental treatments."

Abstract (provisional)

Introduction

Low survival outcomes have been reported for the treatment of locally advanced non small cell lung cancer (LA-NSCLC) with the standard of care treatment of concurrent chemoradiation (cCRT). We present our experience of dose escalation using stereotactic body radiosurgery (SBRT) following conventional cCRT for patients with LA-NSCLC.

Methods

Sixteen patients with a median age of 67.5 treated with fractionated SBRT from 2010 to 2012 were retrospectively analyzed. Nine (56%) of the patients had stage IIIB, 6 (38%) has stage IIIA, and 1 (6%) had recurrent disease. Majority of the patients (63%) presented with N2 disease. All patients had a PET CT for treatment planning. Patients received conventional cCRT to a median dose of 50.40 Gy (range 45--60) followed by an SBRT boost with an average dose of 25 Gy (range 20--30) given over 5 fractions.

Results

With a median follow-up of 14 months (range, 1--14 months), 1-year overall survival (OS), progression free survival (PFS), local control (LC), regional control (RC), and distant control (DC) rates were, 78%, 42%, 76%, 79%, and 71%, respectively. Median times to disease progression and regional failure were 10 months and 18 months, respectively. On univariate analysis, advanced age and nodal status were worse prognostic factors of PFS (p < 0.05). Four patients developed radiation pneumonitis and one developed hemoptysis. Treatment was interrupted in one patient who required hospitalization due to arrhythmias and pneumonia.

Conclusion

Risk adaptive dose escalation with SBRT following external beam radiotherapy is possible and generally tolerated treatment option for patients with LA-NSCLC.

Facebook's Graph Search available in U.S.

Facebook's Graph Search, which lets people more efficiently dig through the massive social network for people, places and other content, is now available on all English versions of the website in the U.S.

The advanced search feature will appear as a normal search field at the top of Facebook.com, though it is not yet available to mobile users.

Graph Search raised privacy concerns when it was originally announced, and this wider launch will mean more people can decide for themselves how useful or invasive it really is.

To run a search, type in a full question that lays out what you want to find. Start with the types of content on Facebook such as photos, people, businesses, movies or bands, or a general topic like tea or badminton. Next, narrow it down with qualifiers like location, dates, friend recommendations or profile information.

For example, you can search for "Photos taken in San Francisco, California, of Golden Gate Bridge in 2013" or "Restaurants in Queens, New York, liked by my friends." If you're planning a trip, look for stores or hotels at your destination visited by locals. If you want a date who shares your hobbies, try something like "Single women who live in San Diego, California, and who like pages I like." Then narrow the results using the detailed categories like age, education, home town or religious views.

Once you start typing, Graph Search will helpfully suggest possible combinations and questions.

To protect your privacy and control exactly who sees your information, take a trip back to your Facebook settings and check your sharing options. You can edit the various parts of your profile so that they are only viewable by you or your friends, or if you don't mind meeting strangers interested in a game of tennis, the public.

Under the privacy settings, open up your activity log for granular control of the entire trail of content you've left on Facebook, including likes, groups and events. You can quickly see all photos of you that are visible to the public and change who can see them. Any public photos can show up in Graph Searches based on their location or or the date they were taken. In the main privacy settings view, you can make some bulk privacy settings by limiting old posts so they are only viewable by certain people, or setting the default privacy settings for your future posts.

The company has certain safeguards in place to protect minors from potentially creepy Graph Searches. Profile details for minors are only viewable to their friends and friends of friends, and friends of friends will only see them in searches if they are also under 18 years old.

Facebook says the feature has been improved since it was first launched in January as a beta feature for select users. The company says the latest version is faster, understands natural language questions better, and returns more relevant results.

AUGUSTA, Maine ? All Maine firefighters have returned from Quebec after battling a blaze following a runaway train derailment 10 miles north of the border that killed at least five people and left about 40 people missing, state officials said Monday.

Maine environmental officials continued to monitor the derailment, and repeated Monday that the oil spill and fires weren't affecting the state's air or water.

Rob McAleer, director of the Maine Emergency Management Agency, said Canadian officials told him that no additional resources are needed.

"I have conveyed Governor LePage's commitment to help in any way we can, should the need arise. Officials in Quebec have told us that at this time they have the resources they need going forward with the response," McAleer said.

Dozens of businesses and numerous homes were destroyed Saturday when 72 oil-filled tankers came loose, sped downhill nearly seven miles into the town of Lac-Megantic, Quebec, causing explosions, an intense fire and thick plumes of smoke.

About a third of the community of 6,000 was forced out of their homes.

In Maine, a dozen protesters on Monday called for independent inspections of the state's railways as well as a reduction in the number of oil tankers traveling across Maine to an Irving-owned refinery in Saint John, New Brunswick.

The demonstrators gathered outside the Hermon offices of the Montreal, Maine & Atlantic Railway Inc., the train's owner.

The Federal Railway Administration, which regulates rail traffic and conducts rail inspections, had no immediate comment.

The Maine Department of Transportation sometimes assists federal regulators but does not regulate what trains haul, frequency of trips, destinations or other matters dealing with interstate commerce, spokesman Ted Talbot said.

Former NFL player sues Redskins over knee injury

WASHINGTON (AP) ? A former NFL player is suing the Washington Redskins and former assistant coach Gregg Williams, saying a career-ending knee injury is the result of a bounty program where Redskins coaches encouraged players to intentionally injure opponents.

Barrett Green, a linebacker who played for the Detroit Lions and the New York Giants between 2000 and 2005, says a career-ending knee injury during a game on Dec. 5, 2004 was the result of a bounty program and a "unusual, outrageous, and an obvious cheap shot."

Prior to joining the Redskins, Williams was the defensive coordinator for the New Orleans Saints and was considered the mastermind behind the bounty scandal that led to unprecedented sanctions from the NFL. He was suspended for one year by the league and is now a senior defensive assistant with the Tennessee Titans. The lawsuit also names former Redskins player Robert Royal, the tight end who hit Green.

Redskins coaches and players told The Associated Press in 2012 that Williams also offered cash rewards for big hits and other plays ? a violation of NFL rules ? when he was coaching Washington's defense from 2004-07. But they differed on whether it was a true bounty scheme that targeted specific players. The NFL investigated Williams' conduct with the Redskins and with other teams where he had coached, but he was sanctioned only for his actions while with the Saints.

The Redskins declined to comment Monday on the lawsuit.

Green was playing for the Giants when he first injured the knee Oct. 31, 2004 in a game against the Minnesota Vikings. He missed nearly a month then returned to play in three more games, including Dec. 5 against the Redskins. The lawsuit says Royal "intentionally lowered his helmet and dove into" Green's knees "at full speed." Green had to be helped off the field, and the lawsuit claims the alleged bounty program would have rewarded the hit as "either a 'knockout' or a 'cart off.'"

Even though Royal lined up as a tight end on the play, which happened in the third quarter, the lawsuit says he also played defense occasionally and therefore would have been coached by Williams.

Green played in one more game after the injury and later underwent surgery to repair a torn ACL. Green did play in one game with the Giants in 2005 but was cut at the end of the season. He tried to latch on with the Houston Texans in 2006 but was cut before the start of the regular season. He now lives in Miami.

At the time of the injury, Green was in the first year of a five-year contract worth more than $13 million, according to the lawsuit. The lawsuit claims the injury cost Green approximately $10 million in lost wages from the contract as well as millions of dollars in future salary and benefits.

Green initially filed his lawsuit in May in state court in Maryland. It has since been moved to federal court in Greenbelt, Md., where it was listed publically Friday. A lawyer for Green, Michael McAllister, declined to comment Monday, as did the Titans. A message left for Royal through his foundation was not immediately returned.

Well, we can't say we didn't see this one coming. Shortly after making a stop by the FCC and being teased on Twitter, MetroPCS has made the Galaxy S 4 official with a $549 plus tax sticker price (and no contracts attached, of course). Samsung's latest flagship is only available across eight covered areas initially (list in source link), however the plan is to set in motion a "full market rollout in the near future." The GS4 is up for grabs in stores starting today, and MetroPCS says extra locations and online availability will "be announced soon."

(AP) ? Trayvon Martin's father testified Monday that he never denied it was his son's voice screaming for help on a 911 call, contradicting police officers' earlier testimony at George Zimmerman's second-degree murder trial.

Tracy Martin was the latest in a series of witnesses called by lawyers on both sides as they seek to convince jurors of who was the aggressor in the nighttime confrontation that left Trayvon Martin, an unarmed black teenager, dead in February 2012. Later in the day, the Florida judge ruled that defense attorneys may present evidence to the jury that Trayvon Martin had marijuana in his system when he died.

The teen's father testified that he merely told officers he couldn't tell if it was his son after his first time listening to the call, which captured the audio of a fight between Martin and Zimmerman.

"I never said that wasn't my son's voice," said Tracy Martin, who added that he concluded it was his son after listening to the call as many as 20 times.

Before Tracy Martin took the witness stand, the lead Sanford, Fla. police investigator who probed Martin's death testified that the father had answered "no" when the detective asked if the screams belonged to Trayvon Martin. Officer Chris Serino played the 911 call for Tracy Martin in the days immediately following Trayvon Martin's death in February 2012.

"He looked away and under his breath he said 'no,'" Serino said of Tracy Martin.

Officer Doris Singleton backed up Serino's account.

Convincing the jury of who was screaming for help on the tape is important to both sides because it would help jurors evaluate Zimmerman's self-defense claim. Relatives of Martin's and George Zimmerman's have offered conflicting opinions about who is heard screaming.

Late in the day, Judge Debra Nelson made a key ruling out of the presence of the jury.

The judge denied a prosecution request to keep out parts of a toxicology report that shows Trayvon Martin had small amounts of marijuana in his system. Prosecutors argued the information would be prejudicial. But defense attorneys said it was relevant because Zimmerman believed Martin was under the influence at the time he spotted him in his neighborhood. Nelson had ruled before the trial that mention of marijuana wouldn't be allowed in opening statements.

Next, the judge considered a prosecution motion to stop defense attorneys from presenting an animated depiction of the fatal fight between Martin and Zimmerman. Prosecutors had requested that the animation commissioned by the defense not be mentioned or played at Zimmerman's trial, claiming it would only confuse jurors. The judge hadn't made a ruling Monday afternoon.

Most of the day was taken up with testimony by a series of Zimmerman's friends, called to testify that the screams on the recording were his. The recording of the 911 call was played multiple times in the courtroom. A gym owner who trained Zimmerman also described him as physically soft and an inferior fighter.

The emergency call captured the confrontation between Zimmerman and Martin shortly before Zimmerman fatally shot the 17-year-old Martin. Zimmerman's mother and uncle testified last Friday it was Zimmerman screaming. Martin's mother and brother also took the witness stand last Friday to say the voice belongs to Martin.

Zimmerman himself once said during a police interview that the screams didn't sound like him, though he and his family later said the screams were his.

Zimmerman, a former neighborhood watch volunteer, has pleaded not guilty to second-degree murder and says he shot Martin in self-defense during an altercation in the gated townhome complex in Sanford where he lived. Martin was there visiting his father and his father's fiancee.

Prosecutors contend that Zimmerman, who identifies himself as Hispanic, was profiling Martin and perceived the teen as someone suspicious in the neighborhood, which had been the site of a series of break-ins. The case sparked protests because police did not charge Zimmerman for 44 days and it touched off a nationwide debate about race and self-defense.

After the call was played for Zimmerman's friend Sondra Osterman, defense attorney Mark O'Mara asked who it was.

"Yes, definitely. It's Georgie," said Osterman, who testified she first met Zimmerman in 2006 while working with him at a mortgage company. Osterman and her husband, Mark, describe themselves as best friends of Zimmerman and his wife.

Under cross-examination, prosecutor Bernie de la Rionda implied that Osterman and her husband, Mark, had a stake in the outcome of the trial because they had written a book about Zimmerman's case and were donating the proceeds to their friend.

Mark Osterman took the witness stand after his wife and said it was Zimmerman's voice screaming when the 911 call was played for him in the courtroom.

Former co-worker Geri Russo also testified it was Zimmerman yelling on the call, as did John Donnelly and Leanne Benjamin, a married couple who became good friends with Zimmerman and his wife.

The prosecutor also played for Sondra Osterman a nonemergency police call that Zimmerman made to report Martin walking through his neighborhood. In the call, Zimmerman uses the words, "F------ punks. These a-------. They always get away." Sondra Osterman identified the voice as Zimmerman's.

When asked by O'Mara if she detected ill will, spite or hatred in his voice, she answered no.

Prosecutors must show that Zimmerman acted with ill will, spite or a depraved mind in order to get a second-degree murder conviction.

Defense attorneys also called the owner of a gym where Zimmerman had gone to lose weight to explain to jurors the mixed-martial arts fighting method called "ground and pound." Defense attorneys have said that Martin slammed Zimmerman's head into the sidewalk while he was on top of him in "a ground and pound" maneuver. To demonstrate the move, gym owner Adam Pollock straddled O'Mara on the courtroom floor. Pollock testified that Zimmerman trained in the form of fighting known as grappling but was an unaccomplished fighter.

"He was physically soft," said Pollock when asked to rank Zimmerman's athletic skill on a scale of 1 to 10.

July is prime TV-buying time ? and these tips can help you beat the retailers

Samsung TV deals hit Best Buy ??and other retailers ??in July HDTV price drops.

July is a terrible time for TV makers and retailers, but that means it's a great time for anyone buying a TV, thanks to high inventories and low store traffic. Seriously, prices on many major brand 55- and 60-inch sets have suddenly dropped a few hundred dollars, and it looks like that pricing will hold at least until the end of the month.

It's been a rough few years for TV makers, and to preserve their ever-shrinking profit margins, they've begun adopting "unilateral pricing policies," setting the absolute lowest price a dealer can sell a TV for. Samsung, Sony, LG, Toshiba and Sharp all went the UPP route, so when you spot a model on Amazon, chances are, you'll see it for the same price at Best Buy or your local independent shop (if it's still in business).

While this pricing scheme does seem to limit your need to shop around, there are lots of tricks and pitfalls that could mean another few hundred dollars of savings ? or loss ? depending on how you go about your purchase. For starters, there are four ways to save on a unilaterally price-fixed HDTV:

Method 1: The waiting game
The longer you hold out for a particular model, the less expensive it will be. TV manufacturers enact new dealer programs, such as instant rebates, to have lower UPP selling prices. In July and August, these limited time "programs" help them adjust inventories on models not moving as fast as forecast.

The start of the TV selling season officially begins with the opening day of the NFL football season, Sept. 5 this year. Between then and the end of the season, Super Bowl Sunday, this year on Feb. 2, is when most TV sets are sold. Generally, there aren?t as many "huge" deals during this time (with the exception of Black Friday). After the Super Bowl, there's another chance to save, before the newest models roll in and the premium pricing show up again. As long as you can bide your time, and buy during the two times of year when TV supply far exceeds demand ? like right now ? you can get the best deal.

Method 2: Avoid sales tax (while you still can)
If you buy a TV online from an out-of-state retailer, you generally (but not always) can avoid paying sales tax on your TV. Many states collect sales tax, but have no system for online merchants.

We do know of a few exceptions. Currently Amazon, one of the largest online TV sellers, collects sales taxes in the states of Arizona, California, Texas, Kansas, Kentucky, New Jersey, New York, North Dakota, Pennsylvania and Washington, where it has major corporate operations. Companies with an in-state presence such as Best Buy and Walmart also collect sales tax when you buy from them online. So you may have to go with a smaller retailer when you look to save money this way.

There is a bill sitting in the U.S. House of Representatives that will require collection of sales tax for these type of sales, but it has yet to come up for a vote. The point is, use this advantage while you still can.

Method 3: Check out unauthorized dealers
Yes, those shadier dealers very often promote pricing well below the official unilateral sticker. However, buying from them is fraught with risks, and requires careful attention to detail and an iron will to pull out if the deal isn't working. It doesn't hurt to have a credit card like American Express, which has a consumer protection plan, too.

Maybe you've done this before. You go to the website of an unauthorized dealer and see the hottest selling TVs at or near dealer cost ? far below the unilateral pricing seen at Amazon or Best Buy. On top of that, the dealer is offering free shipping! How can these unauthorized dealers make a profit? They can?t. Instead, they try to stick you with up-sell charges like "mandatory" shipping insurance and "enhanced" delivery, because they need to buy the TV from an authorized dealer (perhaps at cost through some shady arrangement), but then make some semblance of a profit.

So why do people do it at all? If an unauthorized dealer beats an authorized dealer by $200 to $300 on a $3,400 TV, the seller will only get a few orders. But, if the price is far lower than any other seller, the dealer will get many orders. When the dealer up-sells, the consumer faces what?s known as "cognitive dissonance." This is a feeling of discomfort caused by holding two conflicting beliefs. On one hand, the buyer wants to save money and get the best price. On the other hand, folks don't like deceptive practices or the feeling of being manipulated by a salesman. Consumers will give in to the up-sell so they can still feel they got a better price than anywhere else. In a number of consumer complaints, one retailer was known to slightly reduce the initial price for upgraded shipping, or throw in an HDMI cable for "free."

Sometimes the harrowing ordeal works out, even for the customer. Because unauthorized dealers aren?t shackled by UPP agreements, they are quite willing to make the sale for less profit. Just make sure you never, ever pay with bank check or money order, even if that's part of the savings. Getting cash back if things fall apart is very challenging, and on the flip side, a credit card will protect you from charges if you never receive the merchandise.

And don't even get us started on return policies, extra-cost extended warranties and the rest.

As you can probably tell, we don't think anybody but professional-level hagglers with ironclad credit security should even bother attempting Method 3. It's mostly here as a cautionary tale, to remind you to be wary. Sometimes, the lowest price is not actually the best deal. Method 4: See if you can haggle
Not every authorized retailer is totally happy about this unilateral pricing stuff. A few recent AVSForum posts mentioned select Best Buy stores will match some unauthorized online retailer pricing, while others drop the price at least a bit when confronted with the online alternatives. While some dealers' cash registers are locked out of entering any price lower than the current unified price, it appears that Best Buy?s system is not.

If you don?t want to take the risk of buying from an unauthorized dealer with deceptive practices, it's worth a try at Best Buy, or at a local dealer, to get a price match to an unauthorized dealer's price.

Solar Impulse Ends Cross-Country Flight With Tiny Little 8-Ft Wing Gash

It took two months for Solar Impulse, the little solar-powered plane that could, to make it from Washington state to New York's JFK airport. Two months of 45mph speeds, multiple stopovers, and cursing at clouds. But after surviving all that time and distance, the flight's triumphant finale was cut short by a torn wing.

Late night, an eight-foot tear in the underside of the Solar Impulse prompted the plane to land at 11 pm last night, instead of the originally scheduled Sunday morning touchdown. The only casualty was a planned Statue of Liberty photo op. And getting there a little earlier didn't change the fact that Solar Impulse is now the first solar-powered plane had made it all the way across the US.

Fueled by approximate 12,000 solar cells installed on its wings, and 800 pounds' worth of batteries to store the excess power, the sun-soaked Swiss sailor will be seeking even bigger fish in the future; its next planned flight will take it around the globe in 2015. Hopefully they'll be packing plenty of duct tape.

HATE preacher Abu Qatada will be kicked out of Britain within hours ? finally putting an end to the ?1.7MILLION battle to deport him.

The radical Islamist is due to catch a military flight from RAF Northolt, west London, at around 2am tomorrow morning.

He will be flown to Jordan where he will be taken to the maximum security Muwaqqar prison in a military zone near the capital, Amman.

His wife and five kids are expected to stay in England.

The cleric - once dubbed Osama bin Laden?s European right-hand man - has been staying in south London?s Belmarsh Prison after breaching his bail conditions.

Yesterday, his family slammed the UK for treating him like a prisoner.

His brother Ibrahim said: ?The way he has been treated in Britain is a violation of his human rights. They have treated him like a prisoner, effectively locking him up for ten years which is an injustice.

?If the British government had proved anything against him they would have sent him to court for trial rather than keeping him locked up or home detention.?

Qatada?s cousin Hani Abu Omar added: ?The family is upset. You tell me what he has done wrong??

The Government has been trying to deport him to his homeland, where he was convicted of terror charges in his absence in 1999, for about eight years.

He now faces a retrial on those charges.

The average price for the game at EverBank Stadium is $443.17 according to TiqIQ, which compares prices by several ticket brokers including StubHub and Ticketmaster. It?s the sixth highest-priced game in the country according to the site.

Texas A&M?s showdown with Alabama on Sept. 14 is the most expensive game in the country with an average ticket price of $626.42.


Not surprisingly, seven of the 10 most expensive games in the state feature the Gators.

Florida?s matchup with Florida State on Nov. 30 is the second most-expensive game with an average price of $300.13. The Gators? Sept. 21 game with Tennessee is third on the list at $216.02.

Congruently, Florida also leads the five major programs in the state with an average ticket price of $166 heading into the 2013 season. The Miami Hurricanes are second at $104.78 per ticket followed by Florida State ($90.82), UCF ($52.99) and USF ($48).

Big Data Start-up Crayon Data Shares Plans for India Market

The big data-analytics start-up, Crayon Data, has announced its plans forIndiamarket.

Crayon already has a few customers in the US and UK markets, and its founder and CEO, Suresh V Shankar is confident that they can replicate the success in other emerging markets in Asia Pacific and Middle-East.

Head-quartered out of Singapore, the company has its development center in Chennai.

?We started off formally in October last year and we have made tremendous progress in the last 9 months. We have built up a team in Singapore and India. We developed the prototype versions of the products that we are working on. We signed a couple of very large contracts. We are making significant revenue already in the first year. Over the next three months, we will be having at least the top 10 global names in our client list,? said Shankar.

To start with, Crayon will target the India counterparts of its global customers. But Shankar sees equal opportunity among domestic players also. The company is in the process of developing effective business and engagement models forIndiamarket.

Shankar says that India is a very challenging and interesting market.

?"Understanding the language is a big challenge. Besides, you don?t get the richness of public data set that you typically get in the West. So we have to make a lot more intelligent profiling, based on the limited data sets we have,? he added. Crayon however plans to come up with very competitive price-points forIndiamarket.

Crayon?s focus is primarily on platform and products.

?We did not want to build another services company because that?s not the future when it comes to big data or analytics. We don?t want to be a body shopping player in the big data space. We wanted to solve some very large data problems in the enterprises through a very algorithmic approach and focus on the simplification and visualization of analytics,? added Shankar.

The company?s flagship offerings include ?Richer Engagement?, an interactive consumer engagement platform; Simpler Choices, a product that helps business take informed decisions from various options; and One Drop Analytics.

Crayon has already signed up with a global hospitality company inUKand a global payments provider. The company has also done some pilot projects for a few technology vendors inSingaporeand also a retailer inEurope. Crayon is also seeing traction in industries like e-commerce and banking.

Suresh V Shankar had earlier laid the foundation for RedPill Solutions, a data analytics company, in 2000 which got acquired by IBM in 2009.
